Terms & Conditions
Last updated: 21 March 2025
1. About these terms
These terms govern your use of the website at sentosal.pro and the advisory services provided by Sentosa Legal, a law firm operating from Suite 7-2, Great Eastern Mall, 303 Jalan Ampang, 50450 Kuala Lumpur, Malaysia.
By visiting this website or contacting us to enquire about our services, you indicate that you have read and understood these terms. If any part of these terms is unclear, you are welcome to contact us before proceeding.
2. Nature of services
Sentosa Legal provides legal advisory services in the areas of personal insolvency, corporate insolvency and rescue, and related proceedings before Malaysian courts and statutory bodies. Our services are advisory in character: we explain your legal position, the options available under Malaysian law, and the practical implications of each path.
We do not provide accounting, tax, or financial planning services. Where a matter requires the appointment of a licensed insolvency practitioner under the Insolvency Act 1967 or the Companies Act 2016, we will advise you on that requirement and, where appropriate, coordinate the introduction to a suitable practitioner.
Nothing on this website constitutes a solicitor-client relationship or legal advice specific to your circumstances. A relationship of that nature is established only through a signed engagement letter.
3. Use of this website
This website is made available for general informational purposes. The content is intended to give individuals and company directors a plain-language orientation to the insolvency and corporate rescue landscape in Malaysia. It does not address the specific facts of any particular situation.
You may not use this website for any unlawful purpose, to transmit harmful or misleading information, or to interfere with the operation of our systems. Unauthorised attempts to access non-public areas of the website are prohibited.
We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice. We are not liable for any loss arising from such changes.
4. Accuracy of information
We take care to ensure that the information on this website is accurate and current. Malaysian insolvency law — including the Insolvency Act 1967, the Companies Act 2016, and the debt threshold under Section 5 of the Insolvency Act — is subject to legislative amendment and judicial development. We update this website when we become aware of material changes, but we make no warranty that all information is complete, current, or free from error.
You should not act on information found on this website without first obtaining specific legal advice from a qualified practitioner regarding your own situation.
5. Fees and engagement
The fee amounts displayed on this website represent the starting fee or fixed advisory fee for the described services and are inclusive of applicable taxes unless otherwise stated. Fees are reviewed periodically; the current applicable fee will be confirmed in writing in the engagement letter prior to commencement of any work.
Payment terms, disbursement arrangements, and scope boundaries are set out in the engagement letter specific to each matter. Where a matter is discontinued or falls outside the agreed scope, fees are adjusted proportionately and communicated clearly.
We do not accept engagements on a contingency basis in insolvency or corporate rescue matters.
6. Confidentiality
Information shared with us in the course of an engagement is treated with the same confidentiality obligations that apply to all solicitor-client communications under Malaysian legal professional privilege. This obligation persists after the engagement concludes.
Information submitted through our website enquiry form is handled in accordance with our Privacy Policy. We do not share, sell, or otherwise disclose enquiry data to third parties except where required by law or necessary to respond to your enquiry.
7. Limitation of liability
To the extent permitted by Malaysian law, Sentosa Legal's liability in connection with the use of this website is limited to direct losses caused by our negligence. We are not liable for indirect, consequential, or economic losses arising from your reliance on website content that has not been confirmed in a formal engagement.
Nothing in these terms excludes or limits liability that cannot be excluded under Malaysian law, including liability for fraud or for death or personal injury caused by negligence.
8. Intellectual property
All content on this website — including text, structural layouts, explanatory materials, and the firm's visual identity — is the property of Sentosa Legal or its licensors and is protected by applicable intellectual property laws in Malaysia.
You may access and read website content for personal, non-commercial reference purposes. Reproduction, republication, or distribution of content without written consent is not permitted.
9. Third-party links
Where this website links to external resources — such as the Department of Insolvency Malaysia (MdI), the Companies Commission of Malaysia (SSM), or the Malaysian Bar — those links are provided for convenience. We do not endorse the content of those sites and are not responsible for their accuracy, availability, or content.
10. Governing law
These terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from your use of this website or these terms is subject to the exclusive jurisdiction of the courts of Malaysia.
11. Amendments to these terms
We may revise these terms at any time. The revised version will be posted at this address with an updated date. Continued use of the website following any revision constitutes your acceptance of the updated terms.
